An enduring (continuing) power of attorney is a legal instrument that lets us take action ahead of time - while we are still mentally competent - to maintain control over the decisions touching every part of our lives: financial, personal, and medical. The point is to be prepared, in case (heaven forbid) we reach a state in which we can no longer make decisions for ourselves.

An enduring power of attorney is a legal document that allows any adult to appoint one or more people to handle their affairs in the future, when they themselves can no longer do so.

The grantor (the person granting the power of attorney) signs the document while still in full mental capacity.

The power of attorney specifies a triggering condition - only when that condition is fulfilled (when the grantor no longer "comprehends the matter" and their decision-making capacity has been impaired) does the enduring power of attorney enter into force, and the appointed attorney begins to act.

From that moment forward, the chosen attorney(s) carry out, on the grantor's behalf, all matters for which they were authorized - exactly as the grantor specified in the instructions within the power of attorney.

The attorney will carry out actions concerning your money, your obligations, the management of your bank accounts, the way your money is invested, the management of real estate or business assets, the realization of assets, and handling of rights on your behalf - and more.

Enduring Power of Attorney - Personal Matters

The attorney will make decisions and take actions concerning your welfare and quality of life: daily routine, maintaining a unique lifestyle, fostering an active community life (clubs and groups), employment, learning, or rehabilitation as much as possible, and choosing where you will live (home or assisted-living arrangement) and adapting it to your needs.

Enduring Power of Attorney - Medical Matters

Handling your healthcare matters (regular medical follow-up), choosing a specific caregiver, and more.

Note: an enduring power of attorney for medical matters only can be drawn up before either an attorney or a treating professional - a nurse, doctor, psychologist, or social worker. For specific matters relating to the attorney's authority to make decisions about psychiatric treatment or hospitalization of the grantor, an explanation must also be obtained from a psychiatrist, with the document signed in their presence.

Modification and Revocation

The power of attorney can be amended or revoked as needed - as long as the grantor's mental capacity has not been impaired.

Only an attorney who has completed accreditation by the Israel Bar Association is authorized to draft an enduring power of attorney.
